On January 23, the District Court of Amsterdam granted the request of the National Bank of the Republic of Kazakhstan to withdraw $ 22 billion from the assets of the National Fund, which are a custodian in Bank of New York Mellon, reports Ministry of Justice.
"The court agreed with the position of the National Bank and the Ministry of Justice of the Republic of Kazakhstan, who participated in the process as a third party, and ruled that the assets of the National Fund are inviolable.
The judiciary of the Netherlands had previously denied Moldovan businessman Anatoly Stati the imposition of arrest on the same assets. Stati concealed these facts, thereby misleading the court. The court also ordered A.Stati to reimburse court costs to the Kazakh side.
A similar preliminary arrest was imposed by the Belgian judicial authorities. The work on his appeal continues in accordance with the established procedure. Kazakhstan in the fall of 2017 filed a lawsuit in the Washington District Court against A. Stati, his son Gabriel Stati, as well as their two companies - Ascom Group S.A. and Terra Raf Trans Traiding Ltd. The trial was initiated in connection with the decision of the international arbitration tribunal against the Republic of Kazakhstan for the amount of about $ 500 million.
The lawsuit is aimed at recovering damages and collecting damages arising from the complex and large-scale criminal scheme of fraud committed by the Stati through a group of individuals and corporate structures. Also, Kazakhstan applies for the application of the injunction against the Statute. Meanwhile, the Dutch court decided to freeze the funds of the National Fund of the Republic of Kazakhstan. Chairman of the National Bank of the country Daniyar Akishev later said that this decision was obtained fraudulently.
